About These Terms

These Official Promotion Terms ("Promotion Terms") apply to every giveaway, sweepstakes, drawing, and other promotion (each, a "Promotion") offered by Playforge Inc., 1700 Jericho Turnpike, New Hyde Park, NY 11040 ("Sponsor," "we," "us," or "our") in connection with Box Champs, whether it is announced in the Box Champs app, on this website, by email, or on social media.

A Promotion may also be announced with its own details, such as the prize, the dates entries are accepted, and how to enter ("Promotion Details"). The Promotion Details and these Promotion Terms apply together; if they conflict, the Promotion Details control for that Promotion, except that no Promotion Details may require a purchase or payment, lower the minimum age, or select winners based on gameplay, scores, or any other activity in the app. By entering a Promotion, you agree to these Promotion Terms, the Promotion Details, our Terms of Service, and our Privacy Policy.

No Purchase Necessary

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

Downloading Box Champs and creating an account are free. Nothing purchased, earned, or played in the app affects eligibility, entries, or the odds of winning.

Eligibility

Unless the Promotion Details say otherwise, Promotions are open only to legal residents of the fifty United States and the District of Columbia who are at least 18 years old, or the age of majority where they live if older, at the time of entry. Employees, officers, directors, contractors, and agents of Sponsor and its affiliates, anyone involved in running a Promotion, and the immediate family and household members of each, are not eligible. Every Promotion is subject to all applicable federal, state, and local laws.

How to Enter

Each Promotion's Promotion Details will state how to enter, the period during which entries are accepted (the "Promotion Period"), the prize or prizes, and the date of the drawing.

Unless the Promotion Details say otherwise, each person may enter a Promotion once. Entries made by script, bot, or other automated means, through multiple accounts, or with false information are void.

How Winners Are Selected

Unless the Promotion Details say otherwise, winners are selected in a random drawing from among all eligible entries received during the Promotion Period, conducted by Sponsor or its designee. Winners are not selected based on gameplay, scores, game results, or any other activity in the app. The odds of winning depend on the number of eligible entries received. Sponsor's decisions on all matters relating to a Promotion are final and binding.

Winner Notification

Potential winners will be notified using the contact information connected to their entry or account. A potential winner may be required to confirm their eligibility and to sign and return an affidavit of eligibility, a release of liability, and, where permitted by law, a publicity release, and to provide any information needed for tax reporting, within the time stated in the notification, or within seven (7) days if no time is stated.

If a potential winner cannot be reached, does not respond or return the required documents in time, is found ineligible, or does not comply with these Promotion Terms, that person forfeits the prize, and Sponsor may select an alternate winner in the same manner or, where permitted by law, choose not to award that prize.

Prizes

Prizes are described in the Promotion Details. Prizes have no cash equivalent and may not be transferred, exchanged, or substituted by a winner. Sponsor may substitute a prize of equal or greater value if a prize becomes unavailable for any reason. Prizes are awarded "as is," without any warranty from Sponsor. Any approximate retail value stated in the Promotion Details is Sponsor's good-faith estimate. All taxes, and any costs not expressly included in a prize, are the winner's sole responsibility. Unless the Promotion Details say otherwise, each person and household may win only one prize per Promotion.

Sponsor's Rights

Sponsor may, in its sole discretion, cancel, suspend, modify, or end any Promotion, in whole or in part, at any time and for any reason, including if fraud, technical failure, or any other cause affects its administration, security, or fairness. Sponsor will not change a Promotion in a way that materially reduces entrants' chances of winning or the value of a prize, except as required by law or to address fraud or technical failure. If a Promotion is canceled or ended early, Sponsor may award prizes by random drawing from among the eligible entries received before that time, or, where permitted by law, may choose not to award prizes.

Sponsor may disqualify anyone who tampers with the entry process or the operation of a Promotion, violates these Promotion Terms or our Terms of Service, or acts in a disruptive, abusive, or unsportsmanlike manner.

Publicity and Winner Announcements

Except where prohibited by law, and subject to any publicity release the winner signs, Sponsor may use the winner's name, city and state, likeness, and statements to announce and promote the Promotion and Box Champs, without further payment. Sponsor may publicly announce winners, including on social media, using their first name, last initial, and city and state.

Release and Limitation of Liability

To the fullest extent permitted by law, by entering a Promotion, you release and hold harmless Sponsor, its affiliates, and each of their officers, directors, employees, and agents from any claim, loss, or damage arising out of your participation in the Promotion or your acceptance, possession, or use of any prize. Sponsor is not responsible for lost, late, incomplete, misdirected, or unreadable entries or notifications; for technical, network, or device failures; or for errors in any Promotion materials. The disclaimers and limitations of liability in our Terms of Service also apply to every Promotion.

No Third-Party Sponsorship

Promotions are sponsored solely by Playforge Inc. and are not sponsored, endorsed, or administered by, or associated with, Apple Inc., Google LLC, Meta Platforms, Inc. (including Instagram and Facebook), TikTok, YouTube, or any sports league, team, athlete, or other person or company whose name, likeness, or merchandise may appear in a Promotion. By entering, you release each of them from any liability relating to the Promotion.

Privacy

Information collected in connection with a Promotion is used to run the Promotion and as described in our Privacy Policy.

Disputes

Any dispute relating to a Promotion is governed by the "Governing Law and Dispute Resolution" section of our Terms of Service, including its requirement of binding individual arbitration.

Changes to These Terms

We may update these Promotion Terms at any time by posting a new version on this page. The version in effect when a Promotion is announced applies to that Promotion.

Severability

If any provision of these Promotion Terms is held invalid or unenforceable, the remaining provisions remain in full effect. Some jurisdictions do not allow certain releases or limitations of liability, so some of the above may not apply to you.
